Thanks for choosing Happy Products. This document describes your rights and responsibilities with regard to the return of any goods for any reason. Please take a few minutes to review these Terms and Conditions as your use of this website constitutes your agreement to be bound by these rules. If you do not agree with any of these Terms and Conditions, do not use this website.
This website is owned and operated by Happy Products Pty Ltd ACN 98 067 785 568 ("Happy Products"). We reserve the right to change, delete or add to these terms at any time and without notice. You should check these terms and conditions from time to time for any changes.
Happy Products's published pricing includes standard postage and handling within Australia by Australia Post. Items sent by Australia Post are not insured and do not require a signature upon delivery. Happy Products' packaging is Australia Post approved for delivery to any registered address in Australia. It is your responsibility to ensure that the address provided for delivery is correct and contains a secure, weather-proof mail box or other receptacle to facilitate easy and secure delivery. If your delivery address is not adequate to deliver to, Australia Post may leave a card advising that you have an item to collect from your nearest post office.
Unless otherwise specified, all prices quoted and sales transactions are in Australian Dollars. GST is included in sales where applicable.
If you wish to purchase goods from any country other than Australia, delivery will be calculated by our shopping cart using an automated online feed from our chosen shipping partner, for example DHL, Fedex or Australia Post overseas parcel post. Happy Products reserves the right to adjust international shipping prices on your final order, should they be increased by our shipping supplier without notice. You will be notified in advance or any such adjustment in shipping costs and proceeding with the order will be at your discretion. Happy Products reserves the right to decline orders from countries, regions or towns where a suitable delivery provider does not provide a delivery service. Goods will not be insured unless by express negotiation with Happy Products and Happy Products does not take any responsibility for non-delivery of goods once they have been lodged with a suitable international carrier.
Overseas orders need to have shipping costs priced on request. For overseas orders, Happy Products cannot take responsibility for parcels seized by Customs as these are events and circumstances, which are out of our control, or for parcels seized by authorities because they may contain a product that is not approved for import into the country to which they are being sent. By placing an order with Happy Products, you hereby covenant and agree that you are legally entitled to place an order for the goods requested and that all risk and title passes to you upon dispatch of the same ex Happy Products's Distribution Centre.
Happy Products's warranty does not cover wilful abuse or misuse. This warranty is voided if the goods have received maltreatment, inattention, interference of any kind. Our responsibility does not cover any loss or damage caused by products not used according to product instructions, consequential damage or incidental damages, personal injury, lost profits, lost savings or other economic damages, intentional acts, war, hostilities, terrorism or vandalism or acts of god.
We sell our products by specification and for the use intended. You decide what purpose to use them for and Happy Products makes no representation to this extent.
We will replace or refund (at our discretion) any products delivered to you that are damaged or defective at no charge provided that you notify us within 7 days of receipt. Return of the damaged goods to Happy Products will be at the discretion and cost of Happy Products. Should you receive a product that you feel is damaged or defective, please contact us by telephone or email. Happy Products is dedicated to customer satisfaction through the delivery of high quality products at reasonable prices. We care if you have had an unsatisfactory experience of our products and would like to receive your feedback.
Happy Products will issue a full replacement for items ordered incorrectly by you if you notify us within 7 days of receipt and conditional on all items being returned to Happy Products unopened and in the original packaging at your expense. No item will be exchanged until the original item is received by Happy Products. You will be required to pay for postage of the replacement products.
If Happy Products has sent you the incorrect product from what you ordered through our online shopping facility, please contact us by telephone or email and we will make suitable arrangements for you to receive the item you originally ordered. In the instance where the error has been made by Happy Products, recovery of the incorrectly supplied item will be at the discretion and cost of Happy Products.
Happy Products has done its best to display as accurately as possible the description and colour of the products shown on this website. However, the colours you see will depend on your monitor and Happy Products cannot guarantee that your monitor's display of any colour will be accurate.
If something happens which is beyond Happy Products's reasonable control which makes it impossible, more difficult or more expensive for us to perform our obligations in our usual way then we may wait until it is again possible for us to perform our obligations in our usual way without additional difficulty or expense and we are not liable for any delay which results. If delay or failure to deliver is caused by force majeure or labour dispute we may suspend delivery, supply or completion and/or terminate the contract. Force Majeure means an act of God, war, lightning, fire, earthquake, storm, flood explosion, unavailability or delay in availability of equipment materials or transport, and any other cause whether of the kind specifically enumerated or otherwise which is not within our control. Whilst we shall use reasonable endeavours to comply with your particular delivery requirements and order specifications, you will not be entitled to cancel the whole or part of an order or to claim compensation by reason of our failure to comply with your delivery requirements or minor variations to the goods as a result of changes to the manufacturing processes or specifications. Delivery times are estimates only and we are not liable for delays in delivery. In this respect you agree that time is not of the essence. We may deliver in any number of instalments.
